Regulated Medical Waste
Effective January 1 1998, the California Legislature passed Senate Bill 1034 defining Trauma Scene Waste as Medical Waste. California Health and Safety Codes Section 117600 thru 118360 Any company or person hiring [aiding, abetting, or permitting] an unregistered company or person to clean remove or dispose of Trauma Waste is subject to penalties [as defined] IE: Insurance Companies, Property Owners, Government Agencies, Families.. Any company or person hired to clean a Trauma Scene [as defined] or remove, or dispose of Trauma Scene Waste [as defined] must be registered with the State of California as a Trauma Scene Waste Management Practitioner. 11635 “Bio Hazardous waste” means any of the following [d] Waste, which at the point of transport from the generators site, at the point of disposal, or thereafter, contains recognizable fluid, blood, fluid blood products, containers or equipment containing blood that is fluid. 117690 [c] Medical wastes includes Trauma Scene Waste 117675 “Infectious Agent” means a type of microorganism, bacteria, mold, parasite, or virus that normally causes, or significantly contributes to the cause if, increased morbidity or mortality of human beings. 117705 “Medical waste generator” means [d] Trauma Scene Waste Management Practitioners. 117776 [a] “Trauma Scene” means a location soiled by, or contaminated with human blood, human body fluids, or other residues from the scene of a serious human injury, illness, or death. [b] For purpose of this section, a location may include, but is not limited to a physical structure that is not fixed geographically, such as mobile homes, trailers, or vehicles. 118321 [b] The Legislature hereby finds and declares that , it is in the Interest of the Health and Safety of the Public and Solid Waste Industry to regulate the handling and treatment of waste that, but for Contamination with large quantities of human blood, or body fluids as a result of Death, serious injury, or illness, would be solid waste. 118321.2 [b] the department shall make a list of registered Trauma Waste Management Practitioners “available, upon request, to other public agencies” 118340 [d] Any persons who knowingly treats or disposes, or causes treatment or disposal of, medical waste in violation of this part shall be punished by Imprisonment in the County Jail for one, two, or three years, or by a fine of NOT less than five thousand dollars [$5,000] or more then twenty-five thousand dollars [$25,000], or by both fine and imprisonment. 118350 [c] Aiding, Abetting, or Permitting Violation specified in subdivision [a] 118340 [a] No person who stores treats disposes, or Cause the treatment or disposal of medical waste in a manner not authorized by his or her permit or registration, this part, or the regulations adopted pursuant to this part. 118340 [b] Any persons who stores, treats, disposes, or Causes the treatment or disposal of medical waste in Violation of this part or the regulation adopted pursuant to this part is Guilty of a public offence. 118345 [b] Any person who fails to Register or fails to obtain a Medical Waste Permit in violation of this part, or otherwise violates any provision of this part, any order issued pursuant to Section 118330, or any regulation adopted pursuant to this part, is Liable for a Civil penalty of not more then ten thousand dollars [$10,000] for each violation of a separate provision of this part or, continuing violations., for each day that the violation continues. 117777 “Trauma Scene Waste” means waste that is a regulated waste, as defined in Section 5193 of Title 8 of the California Code of Regulations, and that has been removed, is to be removed, or is in the process of being removed, from a Trauma Scene by a Trauma Scene Waste Practitioner. 117830 [c] Nothing in this chapter shall prevent a district attorney, city attorney, or city prosecutor from bringing any enforcement action for violation Note: Any employee or contractor or restoration co. at a Trauma Scene, prior to clean up by a registered Trauma Scene Waste Practitioner is exposed to a potential Bio Hazard and is subject to Cal OSHA Blood Borne Pathogen Standards, and Dept. of Health Regulations |
